'Fatah to take Israel to The Hague
Fri, 23 Jan 2009 14:59:36 GMT
Palestinian Fatah party has ordered a specialized team to probe Israel's use of banned weapons during its 23-day offensive against Gaza.In an interview with Press TV on Friday, senior Fatah member Abdullah Abdullah said the Palestinian faction has launched an investigation into Tel Aviv's resort to incendiary white phosphorus bombs during the Gaza war.A specialized team is working on the issue, collecting evidence and information from witnesses, said Abdullah, adding that the use of other types of internationally forbidden arms, including depleted uranium, was also under investigation."We will take this to the responsible and relevant authorities including the criminal court in The Hague," he stressed
.The Fatah official's remarks come amid a wave of international calls for a probe into Israel's war crimes against Palestinians in the beleaguered Gaza Strip, which has long been suffering from lack of food, medicine and fuel under an Israeli-imposed blockade that has been in place for over 18 months. Twenty-three days of relentless shelling and airstrikes on the Hamas-run territory left at least 1,330 people - including 460 children and some 106 women - killed and more than 5,450 others wounded.Meanwhile, the Palestinian resistance groups including Islamic Jihad and Hamas as well as Palestinian Authority chief Mahmoud Abbas have called for a national dialogue, urging unity against the 'occupant enemy'.Abdullah lamented the separation of the Gaza Strip from the West Bank as the undeclared Israeli goal to keep Palestinians divided. He further urged all Palestinian groups to support the Egyptian-mediated negotiations to reach a common understanding and a better future for the nation. The top Fatah member criticized the move by Hamas to retain control of the coastal sliver, saying if the movement sought "to replace the Palestinian Authority, it will not work".The Islamic Hamas Movement seized power in the Gaza Strip in June 2007 after the rival Fatah party dismantled prime minister Ismail Haniyah's democratically elected government and formed its own rule in the West Bank city of Ramallah. 'VANAF ZATERDAG 24/1 : AKTIEWEEK GAZA MOET OPEN, DUS GEEN ISRAELISCHE PRODUKTEN KOPEN!
22/01/2009

"The Incendiary IDF"
by Kenneth Roth
The Israel Defense Forces use phosphorous shells--and forfeit credibility.
Human Rights Watch January 22, 2009
Throughout the recent war in Gaza, the Israel Defense Forces (IDF) insisted that it took extraordinary care to spare civilians. But it then prevented journalists and human rights monitors from entering Gaza during the conflict to independently verify this claim.
Now that Human Rights Watch and other observers have been let in, it has become clear that hundreds of Palestinian civilians were not the only casualties of the fighting. So was the credibility of the IDF.
Part of the problem was the IDF's expansive definition of a military target. It attacked a range of civilian facilities, from government offices to police stations, on the theory that they all provided at least indirect support to Hamas militants. But by that theory, Hamas would have been entitled to target virtually any government building in Israel on the ground that its office workers indirectly supported the IDF. That would make a mockery of the distinction between civilians and combatants that lies at the heart of the laws of war, which require direct support to military activity before civilians become legitimate military targets. Behind the unsupportable legal claim seemed to lie a determination to make Gazans suffer for the presence of Hamas--a prohibited purpose for using military force.
The IDF's credibility probably took the biggest hit on the issue of its use of white phosphorous. A typical artillery shell of white phosphorous releases 116 phosphorus-soaked wedges which, upon contact with oxygen, burn intensely, releasing a distinctive plume of smoke. That smoke can be used legitimately to obscure troop movements, but white phosphorous can be devastating when used in urban areas, igniting civilian structures and causing people horrific burns. Its use by the IDF in densely populated sections of Gaza violated the legal requirement to take all feasible precautions during military operations to avoid harming civilians. It never should have been deployed.
The IDF has tried to defend itself with denial and obfuscation. It first denied using white phosphorous at all. Then, when that proved untenable, it claimed that use was limited to unpopulated areas of Gaza. Neither claim is true. On Jan. 9, 10 and 15, a Human Rights Watch military expert personally observed white phosphorous being fired from an artillery battery and air burst over Gaza City and the Jabalya refugee camp. Its telltale jellyfish-like plume was a dead giveaway, as can be seen from many photographs that are now emerging from Gaza of white phosphorous raining down on civilian areas.
The Times of London also photographed an IDF artillery battery firing white phosphorous shells. The shells are color coded and labeled with the IDF term for white phosphorous--"exploding smoke." They are also marked with the code used by the U.S. manufacturer of white phosphorous--M825A1. Similarly marked and color-coded shells and other evidence of white-phosphorous use have now been recovered from urban areas of Gaza where they fell to earth.
As for obfuscation, the IDF claimed that all weapons it used were "legal," but that begs the critical question of how they were used. The use of white phosphorous is legal in certain circumstances but illegal when deployed in a way that causes unnecessary or indiscriminate harm to civilians. The IDF cited press reports suggesting that the International Committee of the Red Cross supported its position, but in a rare public comment, the ICRC denied that claim.
The IDF's latest line is that the shells fired in Gaza "contained phosphorus material but were not actual phosphorus shells." That is semantic game-playing. Nothing that indiscriminately burns the way the IDF's shells did, regardless of name, should be used in densely populated areas.
Awful as it is to have white phosphorous raining down on you, the IDF probably caused more civilian casualties with its use of 155 mm high-explosive artillery shells in Gaza. These weapons can injure civilians from blast and fragmentation over an area with a radius of as much as 300 meters. That's roughly the equivalent of taking three football fields, lining them end to end and then rotating them around the point of the shell's impact. In the densely populated residential areas of Gaza, where Human Rights Watch saw these shells used on Jan. 15, they can cause extensive civilian casualties. Such use clearly violates the laws-of-war prohibition of indiscriminate attacks because the shells strike military targets and civilians without distinction.
Such unlawful endangering of civilian life in Gaza cannot be justified by Hamas' deliberate and indiscriminate attacks on Israeli cities and towns. Illegality by one side to a conflict does not excuse illegality by the other. And as should be obvious, it is hardly in Israel's interest to degrade international law protecting civilians.
Predictably, the IDF holds Hamas wholly responsible for civilian casualties in Gaza, alleging that Hamas combatants stored weapons in mosques and fought from among civilians. Those allegations may or may not be true. Long experience, as during the 2006 war in Lebanon, shows that we must take such ritual IDF pronouncements with a grain of salt. We will not know exactly how Hamas waged the war until human rights monitors can conclude the on-the-ground investigations that they are only just beginning because of the IDF's earlier refusal to let them into Gaza.
Israelis seem dismayed that the world has not embraced the justness of its latest war in Gaza. Of course Israel is entitled to defend itself from Hamas' rocket attacks, but when it does so in violation of its duty to spare civilians, and with so massive a civilian toll, public outrage is entirely predictable. Meanwhile, the IDF does itself no favor when it resorts to censorship, PR techniques and misrepresentation rather than subject its conduct to the open and independent scrutiny that should characterize any military that is genuinely committed to respecting the laws of war.'

Rabbijn Awraham Soetendorp 5

Loss and Recovery of Self Under Colonialism.

Begrijpt u nu waarom uw moreel gezag ter discussie staat?

Rabbijn Awraham Soetendorp 4

Geachte rabbijn Awraham Soetendorp,

Groet,
In afwachting van uw antwoord,
Stan van Houcke,
journalist/ schrijver,
Amsterdam.

Rabbijn Awraham Soetendorp 3

Geachte rabbijn Avraham Soetendorp,

Kinderen in GazaDe Gaza-strook bleef lang hermetisch afgesloten.

LAMBETH UNISON CALLS FOR BOYCOTT OF "APARTHEID" ISRAEL

The Lambeth Branch of UNISON, the second largest trade union in the UK, has voted to condemn the recent slaughter of Palestinians and the ongoing occupation by Israel at a meeting of its Branch Committee this morning. At its monthly meeting of representatives, the Branch called for, "an immediate end to the slaughter of defenceless people and the [ongoing] siege of Gaza." The Branch concluded that, "Israel is an...apartheid state," and has advocated academic, economic and cultural boycotts of Israel in an effort to delegitimise the Occupation of Palestine, and build international and domestic pressure against the state. For over 6 decades Israel has carried out policies of ethnic cleansing against the Palestinian people.1.5 million people live in Gaza, which is now effectively open air prison. For years Israel has blocked the transport of food, medicine and vital supplies forcing the people of Gaza to live in inhumane conditions and the vast majority of people are unemployed. Palestinian medical sources say at least 1,300 Palestinians have been killed and 5,500 injured as a result Israeli's latest military offensive. The United Nations states that some 50,800 people are now homeless and 400,000 are without running water. Staff in Gaza report that many more people could die as medical equipment runs out.Nationally, UNISON has committed to send a donation of 10,000 to Medical Aid for Palestinians (MAP) and Lambeth Branch is raising its own donations locally. The Branch voted to affiliate with the Palestine Solidarity Campaign (PSC) and to work towards submitting an emergency motion to the UNISON National Delegate Conference in July, demanding diplomatic sanctions and boycotts against Israel. The Branch also resolved to build links with Palestinians, Israelis and Egyptians who oppose the assault on Gaza and to send messages of solidarity to those students at British universities who have undertaken occupations demanding support from their institutions for the Palestinian right to education.Lambeth UNISON's International Officer, Gurmeet Khurana, stated: "The British trade union movement played a crucial part in denouncing and delegitimising the racist ideology of Apartheid in South Africa, and now it must do the same for Israel. The only peaceful solution is one brought about by political and economic equality in the Middle East, and as such the policy of the Israeli state in carrying out ethnic cleansing needs to be condemned unequivocally."EndsNotes for Editors1. Gideon Levy / Gaza war ended in utter failure for Israel
By Gideon Levy

On the morrow of the return of the last Israeli soldier from Gaza, we can determine with certainty that they had all gone out there in vain. This war ended in utter failure for Israel. This goes beyond the profound moral failure, which is a grave matter in itself, but pertains to its inability to reach its stated goals. In other words, the grief is not complemented by failure. We have gained nothing in this war save hundreds of graves, some of them very small, thousands of maimed people, much destruction and the besmirching of Israel's image. What seemed like a predestined loss to only a handful of people at the onset of the war will gradually emerge as such to many others, once the victorious trumpeting subsides.
The initial objective of the war was to put an end to the firing of Qassam rockets. This did not cease until the war's last day. It was only achieved after a cease-fire had already been arranged. Defense officials estimate that Hamas still has 1,000 rockets. The war's second objective, the prevention of smuggling, was not met either. The head of the Shin Bet security service has estimated that smuggling will be renewed within two months. Most of the smuggling that is going on is meant to provide food for a population under siege, and not to obtain weapons. But even if we accept the scare campaign concerning the smuggling with its exaggerations, this war has served to prove that only poor quality, rudimentary weapons passed through the smuggling tunnels connecting the Gaza Strip to Egypt. Israel's ability to achieve its third objective is also dubious. Deterrence, my foot. The deterrence we supposedly achieved in the Second Lebanon War has not had the slightest effect on Hamas, and the one supposedly achieved now isn't working any better: The sporadic firing of rockets from the Gaza Strip has continued over the past few days. The fourth objective, which remained undeclared, was not met either. The IDF has not restored its capability. It couldn't have, not in a quasi-war against a miserable and poorly-equipped organization relying on makeshift weapons, whose combatants barely put up a fight. The heroic descriptions and victory poems written abut the "military triumph" will not serve to change reality. The pilots were flying on training missions and the ground forces were engaged in exercises that involved joining up and firing weapons. The describing of the operation as a "military achievement" by the various generals and analysts who offered their take on the operation is plain ridiculous. We have not weakened Hamas. The vast majority of its combatants were not harmed and popular support for the organization has in fact increased. Their war has intensified the ethos of resistance and determined endurance. A country which has nursed an entire generation on the ethos of a few versus should know to appreciate that by now. There was no doubt as to who was David and who was Goliath in this war. The population in Gaza, which has sustained such a severe blow, will not become more moderate now. On the contrary, the national sentiment will now turn more than before against the party which inflicted that blow - the State of Israel. Just as public opinion leans to the right in Israel after each attack against us, so it will in Gaza following the mega-attack that we carried out against them.'

Kinderen in GazaDe Gaza-strook bleef lang hermetisch afgesloten. * Bron: http://www.ochaopt.org, 20 januari 2009'

'The BBC - Impartial or Immoral?
Despite this carnage, despite the fact that 89% of Gaza’s 1.5 million residents have received no humanitarian aid since Israel began its assault (
http://www.maannews.net/en/index.php?opr=ShowDetails&ID=35162), the Guardian notes that the BBC has refused to broadcast a national humanitarian appeal for Gaza, "leaving aid agencies with a potential shortfall of millions of pounds in donations." (Jenny Percival, ‘Broadcasters refuse to air Gaza charity appeal,’ The Guardian, January 23, 2008;
http://www.guardian.co.uk/world/2009/jan/22/gaza-charity-appeal)
The Disasters Emergency Committee (DEC), an umbrella organisation for 13 aid charities, launched its Gaza appeal yesterday saying the devastation was "so huge that British aid agencies were compelled to act". (Ibid.)
By refusing to give free airtime to the appeal, the BBC made a rare decision to breach an agreement dating back to 1963. Other broadcasters then also rejected it. The DEC's chief executive, Brendan Gormley, said:
"We are used to our appeal getting into every household and offering a safe and necessary way for people to respond. This time we will have to work a lot harder because we won't have the free airtime or the powerful impact of appearing on every TV and radio station." (Ibid.)
A BBC website article defending the BBC’s refusal to broadcast the Gaza appeal, asserted:
"The BBC decision was made because of question marks about the delivery of aid in a volatile situation and also to avoid any risk of compromising public confidence in the BBC's impartiality in the context of an ongoing news story." (http://news.bbc.co.uk/1/hi/uk/7846150.stm)
Gormley rejected the BBC's claim that there were question marks about the delivery of aid, saying 100 lorries a day were entering Gaza. He also challenged the alleged problem with "impartiality":
"We are totally apolitical and are driven by the principles of the Geneva conventions in terms of impartiality and neutrality. This appeal is a response to those humanitarian principles. The BBC seems to be confusing impartiality with equal airtime." (Percival, op. cit)
ITV said: "The DEC asked all broadcasters if they could support the appeal. We (the broadcasters) assessed the DEC's requirements carefully against the agreed criteria and we were unable to reach the consensus necessary for an appeal." (Ibid.)
Sky said: "We were considering this request internally when the DEC contacted us to let us know that the BBC had decided not to broadcast the appeal at this time. As, by convention, if all broadcasters do not carry the appeal then none do, the decision was effectively made for us." (Ibid.)
This immoral and callous decision by the BBC in response to the suffering of the people of Gaza should not go unchallenged. Please complain using the phone number and email addresses below:

De Israelische Oorlogsmisdaden 24

Numerous members of the public have written to us expressing their bewilderment at the violence of Israel’s 22-day attack on Gaza killing upwards of 1,300 people and wounding 4,200. To many witnessing the onslaught on their TV screens (especially Al Jazeera) this appeared to be an act of state sadism.
Israeli forces repeatedly bombed schools (including UN schools), medical centres, hospitals, ambulances, UN buildings, power plants, sewage plants, roads, bridges and civilian homes.
On January 15, Helpdoctors.org reported that Al Quds hospital had been "again the target of bombing". Some 50 patients, 30 in wheelchairs, fled as the burning hospital was "totally destroyed". (
http://translate.google.com/translate?u=http%3A%2F%2Fwww.helpdoctors.org%2F&langpair=fr%7Cen&hl=fr&ie=UTF-8&oe=UTF-8&prev=%2Flanguage_tools)
The hospital’s medical director said, "My heart is crying," as he described how intensive care patients and premature babies in incubators were wheeled onto the street in the middle of the night. (
http://news.bbc.co.uk/2/hi/middle_east/7833919.stm)
On January 19, UN official John Ging said half a million people in Gaza had been without water since the conflict began - huge numbers were without power. Four thousand homes have been ruined and tens of thousands of people are homeless. (
http://news.bbc.co.uk/1/hi/7836869.stm)
It is now known that the Israeli army (the IDF) used white phosphorus incendiary weapons - designed to burst over a wide area and burn to the bone - against civilian targets, including hospitals and UN buildings. The use of these weapons against civilians is a war crime.
Surgeons in Gaza have reported numerous, unusual cases where bomb victims had lost both legs rather than one, raising suspicions that the Israeli military used Dense Inert Metal Explosive (Dime) bombs - experimental weapons that generate micro-shrapnel that burns and destroys everything within a four-metre radius. Dr. Erik Fosse, a Norwegian surgeon, commented:
"We suspect they used Dime weapons because we saw cases of huge amputations or flesh torn off the lower parts of the body. The pressure wave [from a Dime device] moves from the ground upwards and that's why the majority of patients have huge injuries to the lower part of the body and abdomen... The problem is that most of the patients I saw were children. If they [the Israelis] are trying to be accurate, it seems obvious these weapons were aimed at children." (Patrick O’Connor, ‘Reports reveal devastation wreaked by Israeli military in Gaza,’ World Socialist Web Site, January 20, 2008;
http://www.wsws.org/articles/2009/jan2009/gaza-j20.shtml)
The IDF also used hideous "flachette bombs" - high-tech nail bombs that shower victims with small metal darts that penetrate flesh and bone.

Obama 76

Obama urges open Gaza borders
Thu, 22 Jan 2009 22:08:39 GMT
http://www.presstv.com/Detail.aspx?id=83365&sectionid=3510203
US President Barack Obama has called on Israel to open Gaza's border crossings to aid and commerce, as part of a lasting ceasefire in the region.
"Now we must extend a hand of opportunity to those who seek peace, as part of a lasting ceasefire, Gaza's border crossings should be open to allow the flow of aid and commerce," Obama said during a maiden visit as president to the State Department.
The president, in his first major comments on the Middle East conflict since he inaugurated on Tuesday, called for a monitoring regime involving the Palestinian Authority and the international community for open Gaza borders.
"Relief efforts must be able to reach innocent Palestinians who depend on them," Obama said.
The president also said he was deeply concerned about the loss of civilian life in the Gaza conflict. However, he added Hamas must stop firing rockets into Israeli territory, and that he was fervently committed to Israel's security.'

Gaza under siege
Phyllis Bennis
In These Times, 22 January 2009
Gaza has been redefined. Gaza is now synonymous with carnage, rising death tolls, destroyed schools, and city streets slick with blood. As In These Times went to press, the death toll of Palestinians had passed 750—219 of them children. Twelve Israelis had died, four of them by “friendly fire.”This is not a war against Hamas rocket fire, as Israel claims. (See “Gaza in the Crosshairs,” page 30.) It is a war against a defenseless, imprisoned population. The Israeli-Hamas ceasefire that Egypt negotiated in June 2008 was largely holding. But in the five months between June and November, Gazan civilians faced a tightening siege, with shortages of food, clean water, electricity, fuel, hospital equipment and medicine—conditions severe enough for humanitarian workers to deem the situation in Gaza as catastrophic.Israel violated the ceasefire with a Nov. 4 attack in Gaza that killed six Palestinians. On New Year’s Eve the influential Israeli daily Ha’aretz, reported that senior Israeli defense officials had confirmed that the government “instructed the Israel Defense Forces to prepare for the operation over six months ago, even as Israel was beginning to negotiate a ceasefire agreement with Hamas. … [A]lthough the lull would allow Hamas to prepare for a showdown with Israel, the Israeli army needed time to prepare, as well.”The article described the key components of Israel’s war strategy this way: “long-term preparation, careful gathering of information, secret discussions, operational deception and the misleading of the public.”On Jan. 4, in an address to the Israeli Cabinet, Foreign Minister Tzipi Livni explained the value of diplomacy this way: “The intensive diplomatic activity of the last few days aims to alleviate the pressure for a ceasefire and to allow time for continuing the military operation in order to achieve its goals.”The United States has succeeded in providing full diplomatic protection to Israel in the U.N. Security Council, preventing Tel Aviv from being held accountable for violating international law—specifically, prohibitions against collective punishment, against targeting civilians and against disproportionate force. So far, council members have not had the courage to insist on a public vote on a U.N. resolution demanding an immediate ceasefire and immediate access for humanitarian support. It is likely the General Assembly will respond. But so far, Gaza cannot look to the United Nations for help.It remains for the people of the world to respond, and they have—”Free Gaza” humanitarian ships have sailed to Gaza (although Israel blocked the group’s sixth voyage in international waters), tens of thousands have protested around the world, including inside Israel, and the independent media has continued to defy Israel’s effort to keep journalists out of Gaza.Pressure must also be placed on President Obama. He promised to change the mindset that led to war. The Israeli assault on Gaza reflects the same mindset as the U.S. invasion against Iraq: the belief that power equals right, that terror can somehow be destroyed by war. We must urge Obama to reclaim his commitment to change. The U.S. government has enabled this attack—by funding, protecting and arming Israel. U.S. citizens must be part of the worldwide voice demanding an immediate, unconditional ceasefire. There is no time to waste.'

'Israeli crimes against humanity in Gaza
Richard Falk interviewed by Michael Slate

Revolution Online, 20 January 2009
Revolution newspaper is publishing this interview courtesy of “Beneath the Surface” radio show hosted by Michael Slate on KPFK, Los Angeles. The views expressed by Professor Richard Falk in this interview are, of course, his own, and he is not responsible for the views expressed elsewhere in this newspaper. Richard Falk has edited this interview for publication.
Richard Falk is the UN special rapporteur on human rights in the Occupied Palestinian Territories. He is professor emeritus of international law at Princeton University and the author of more than 50 books on war, human rights and international law, including Achieving Human Rights; Crimes of War: Iraq, with Irene Gendzier; and Israel-Palestine on Record: How the New York Times Misreports Conflict in the Middle East, with Howard Friel. In a recent statement issued by the UN, “Gaza: Silence Is Not An Option,” he called Israeli policies in the Occupied Territories a crime against humanity. On December 15, 2008 Professor Falk was denied entry into the Occupied Palestinian Territories by the Israeli government.
Michael Slate: What are the duties of a Special Rapporteur for the United Nations?Richard Falk: A Special Rapporteur is a post created by the Human Rights Council in Geneva, which is the main organ of the UN that is supposed to address human rights. There are two kinds of special rapporteurs. My kind deals with a particular country or situation that calls for special attention. The other country special rapporteurs are for Myanmar, Somalia, and North Korea. The other kind are thematic special rapporteurs that deal with human rights issues such as summary executions, child soldiers, disappearances, religious suppression, food, health, and the like. All in all, there are 29 special rapporteurs, and each of us is supposed to report once a year to the General Assembly in New York, and once a year to the Human Rights Council in Geneva. My particular job is to monitor what’s going on in the occupied Palestinian territories, which means really Gaza, the West Bank and East Jerusalem, and to assess the situation as it exists in relation to international humanitarian law, UN Charter, human rights law, and international criminal law. That’s what I’ve been trying to do since selected in May 2008.Slate: In that role, you are supposed to have access to any country that’s a signatory of the UN?Falk: Yes, that’s right. And in fact it’s a legal obligation of a member of the UN to cooperate with the UN in discharging its official responsibilities. And so my exclusion from Israel a couple of weeks ago is in direct violation of Israel’s obligations to cooperate with the UN. It should be understood that this is part of a wider Israeli policy that was being pursued at the time to exclude journalists and to keep informed observers who live within Gaza from leaving. So it was part of a politics of diversion to prevent people from seeing and reporting upon what was happening on the ground, and I suppose this was an aspect of Israel’s preparation for the kind of events that have been taking place in Gaza since December 27th.Slate: Israel has a history of refusing entry to people investigating the situation in the occupied territories – there’s Bishop Tutu, Norman Finkelstein and you. In your case there seems to have been a lot of forces marshaled against you from the very beginning. Both Israel and the U.S. opposed your appointment as Special Rapporteur last Spring. In your case, they accused you of being “biased.” Can you speak to that?Falk: I think that Israel’s expulsion approach, which has been applied to other people as well as to myself, is to do all that it can to shift the focus to the observer rather than what’s being observed, it distracts the attention of the wider public from the ugly reality on the ground in Gaza. They’ve been quite successful in persuading much of the mainstream media to follow that track. So often when I’m interviewed, for instance, it’s all about whether I’m biased or not, not about whether my reporting is accurate, and whether or not I am truthful and objective in relation to the realities of the occupation. I always say that the real test of my qualifications is whether I’m accurate and truthful, and that is a test that I welcome. You can’t treat an unequal reality as if both sides have an equal claim to be persuasive. So I think that this emphasis on bias should be challenged by looking at the actual reports and assess whether they’re accurate or not. I would stand by the truthfulness of what I’ve been trying to say and the reasonableness of my legal interpretations of what the Israeli policies imply in terms of violations of the rights of the Palestinian people, and criminal accountability for the Israeli military and political leaders that have put these policies in place and kept them in force, and have magnified their character during their post-December 27th military campaign in Gaza.Slate: It’s so enraging to read the lies that roll off, and the misrepresentations that roll through the newspapers in particular in this country. People are kept ignorant of the truth of what’s going on in Israel and Palestine, what’s going on in the occupied territories. For instance, one of the biggest lies out there about this massacre is that Israel is simply responding to a breach of the peace by Hamas; that they are just protecting the safety and security of their people.Falk: I think that again this is a reflection of the willingness of much of the world’s media, particularly here in the US, to go along with assertions that are just not concerned at all by the true nature of the relevant reality. The reality was that for the year before Israel attacked Gaza at the end of 2008, not a single Israeli death had occurred as a result of the few rockets that had been fired. Further, Hamas had all along indicated its willingness to enter a long term truce with Israel up to ten years. Beyond that, the temporary truce that had been negotiated under Egyptian auspices last June, had held pretty well until Israel broke it on November 4, by attacking some alleged Palestinian militants within Gaza and killing six people. After that the interaction becomes confusing, with some rockets fired, but it’s not clear whether these rockets were fired under the authority of Hamas, or by quite independent groups in Gaza. There are other militias, some of which are tied to Fatah, the adversary of Hamas, and they may try to embarrass Hamas or cause it difficulties. I should say at the same time that in my role as special rapporteur, I have consistently said that if these rockets are aimed at civilian targets they are unlawful, immoral, and also represent politically imprudent ways of demonstrating the persistence of Palestinian resistance to an unlawful occupation.Slate: You’ve written about the difference between what Israel is doing to Gaza and what Hamas is doing to Israel. You’ve described the Palestinian rockets, for example, as a crime of survival. What did you mean by that?Falk: What I meant by such a comment is that the Palestinians basically have no weapons and they have a strong incentive to try to demonstrate that they’re not going to surrender, that they’re not going to allow this kind of occupation to go unchallenged, and their situation of subjugation gives them few alternatives. They seem to lack the imagination or the capabilities to do anything that might be more effective, and at the same time being less helpful than the rockets to Israel in its search for legal and moral pretexts for the continuous violence directed at Gaza. The difficult question to pose is where there exist feasible forms of resistance that are less susceptible to allegations of unlawfulness. There’s no question that the Geneva Conventions that spell out the requirements of international humanitarian law prohibit aiming military weapons at civilians. It is true that these rockets are incredibly inaccurate and have done surprisingly little damage. But they are aimed at civilians and therefore they do violate international humanitarian law, and I think Israel has effectively brought attention to the rockets as providing a political cover and pretext for mounting outrageously disproportionate responses, and diverting attention from their policies of targeted assassination of Hamas leaders that have killed far more Gazan civilians than the rockets. Israel has been orchestrating the rocket narrative to make its violence appear to be “defensive” and “reasonable,” neither of which it is.The November 4 Israeli attack on Gaza certainly seemed to be an Israeli provocation that was designed to activate a set of forces that the IDF [Israeli Defense Forces] had been planning to put in play for months, and was connected with the domestic elections that are forthcoming in Israel in February. The Israeli leadership and public seemingly wanted a non-diplomatic confrontation in Gaza. They didn’t pursue the numerous diplomatic openings that Hamas had provided by offering repeatedly a truce and even suggesting that if Israel would leave the occupied territories, as long required to do by a unanimous UN Security Council Resolution, peaceful coexistence would be acceptable to Hamas for the indefinite future. Recall that Gaza has been unlawfully and harshly occupied since 1967, all along in violation of international humanitarian law,'

Boycot Israel 16

O X F O R D C I T Y C O U N C I L

MOTION ADOPTED AT A MEETING OF THE FULL COUNCIL ON 19th JANUARY 2009

GAZA/ISRAEL CONFLICT

1) This Council is extremely concerned and saddened, as are many Oxford residents, at the tragic loss of life in Gaza and Israel because of military action. We deplore the violence on both sides but believe that that the Israeli military response had been and continues to be disproportionate.

2) We condemn the loss of civilian life and the destruction of homes, mosques, schools and infrastructure, including United Nations facilities, by Israel in Gaza. These attacks will not bring peace and act as a recruiting ground for extremist groups.

3) This Council welcomes the UK Government's call for a ceasefire and asks the Leader to write to the Prime Minister urging him to act urgently to ensure:-

a) An immediate end to Israel's military assault on Gaza
b) An immediate end to the blockade and siege of Gaza
c) Action to end Israel's violations of international law
d) Support to address the unfolding humanitarian disaster in Gaza.
e) Israel should compensate the victims for the loss of the life and property resulting from this unprincipled aggression

4) This Council wishes to see:-

a) An immediate ceasefire
b) The withdrawal of the Israeli military from Gaza
c) Greater international pressure through the UN on Israel and the Palestinians to reach a political agreement
d) An end to the isolation, impoverishment and virtual imprisonment of the people of Gaza

5) To this end we recognize the importance of:-

a) Boycotting Israeli products and companies
b) Increased support for the friendship links between Oxford and both Neve Shalom/Wahat el Salam (Oasis of Peace) and Ramallah
c) An immediate arms boycott of Israel by Britain and other countries

6) We welcome:-

a) The practical support by Oxfam, Medical Aid to Palestine and others to assist the people of Gaza
b) The efforts of both Oxford MPs to persuade the Government to do everything possible to press for an immediate ceasefire, to challenge the blockade and help to bring peace to the people of Palestine and Israel."

De Israelische Oorlogsmisdaden 21

'In its heavy hangover period after the bloodbath in Gaza, Israel has awaken to massive, unprecedented accusations by some of the most prominent jurists around the world of committing war crimes of the worst types, amounting to crimes against humanity. After every Israeli massacre we've heard the same talk, a cynic must be itching to respond. True, but never at any level close to this. Associating Israel with the term "war crime" has really become mainstream, for the first time.

Even the incredibly dominant Zionist influence in mainstream western media outlets (BBC, FOX, NYT, CNN, Le Monde, most major European papers, you name it!) has failed to stop the spread of this fatal association with war crimes. Like its white phosphorous bombs that burnt Gaza children more than anything else, ironically, Israel's every desperate attempt to extinguish the flames of this accusation with propaganda and spin has only caused them to flare up even further.

In his perceptive style, UN Rapporteur Richard Falk here focuses on a particularly significant -- morally and legally -- aspect of Israel's crime in Gaza that not many have emphasized: the fact that Palestinians in the besieged and heavily bombarded Gaza Strip had absolutely no where to escape to, unlike in the great majority of wars. Even UN schools used as shelters were intentionally targeted in a long-honored Israeli policy of terrorizing the entire civilian population into submission or revolt against the resistance.

This exceptionally barbaric, Nazi-like policy has failed in Lebanon and in Gaza. Still, given the dizzying rise in Israel's impunity during the Bush -- especially post 9/11 -- era, no criticism or condemnation has managed to deter Israel from committing more crimes. Nothing, it seems, can stop it from realizing its genocidal potential in the near future. Conscientious Jewish intellectuals have raised the solgan: Israel must lose! I jsut add to that, only intense, persistent pressure, particularly in the shape of BDS, has any chance whatsoever in ending Israel's impunity and making its policy lose. The massive grassroots movement around the world is marching in the right direction, finally.

UN human rights official: Gaza evokes memories of Warsaw Ghetto

There is evidence that Israel committed war crimes during its 22-day campaign in the Gaza Strip and there should be an independent inquiry, UN investigator Richard Falk said Thursday. The mental anguish of the civilians who suffered the assault is so great that the entire population of Gaza could be seen as casualties, said Falk, U.N. special rapporteur on human rights in the occupied West Bank and Gaza Strip.Falk, speaking by phone from his home in California, said compelling evidence that Israel's actions in Gaza violated international humanitarian law required an independent investigation into whether they amounted to war crimes."I believe that there is the prima facie case for reaching that conclusion," he told a Geneva news conference.
Falk said Israel had made no effort to allow civilians to escape the fighting."To lock people into a war zone is something that evokes the worst kind of international memories of the Warsaw Ghetto, and sieges that occur unintentionally during a period of wartime," Falk, who is Jewish, said, referring to the starvation and murder of Warsaw's Jews by Nazi Germany in World War Two."There could have been temporary provision at least made for children, disabled, sick civilians to leave, even if where they left to was southern Israel," the U.S. professor said.Falk said the entire Gaza population, which had been trapped in a war zone with no possibility to leave as refugees, may have been mentally scarred for life. If so, the definition of casualty could be extended to the entire civilian population.Falk, who was denied entry to Israel two weeks before the assault started on Dec. 27, dismissed Israel's argument that the assault was for self-defense in the light of rocket attacks aimed at Israel from the Hamas-ruled Gaza strip."In my view the UN charter, and international law, does not give Israel the legal foundation for claiming self-defence," he said.Israel had not restricted fighting to areas where the rockets came from and had refused to negotiate with Hamas, preventing a diplomatic solution, Falk said.A Foreign Ministry official rejected Falk's accusations. "There's no need to lose one's temper. Falk is a well-known Israel hater," he told Army Radio.'

Om de propaganda van de pro-Israel lobby niet in gevaar te brengen verzwijgen mijn Nederlandse collega's informatie die in november 2008 de gerenommeerde Britse correspondent Jonathan Cook gaf: 'According to the daily Jerusalem Post, Israeli policymakers have sought to reinforce the impression that “it would be pointless for Israel to topple Hamas because the population [of Gaza] is Hamas”. On this thinking, collective punishment is warranted because there are no true civilians in Gaza. Israel is at war with every single man, woman and child. In an indication of how widely this view is shared, the cabinet discussed last week a new strategy to obliterate Gazan villages in an attempt to stop the rocket launches, in an echo of discredited Israeli tactics used in south Lebanon in its war of 2006.' Zie: http://www.counterpunch.org/cook11172008.html

Blaming the Victim.
